Rangoon copyright infringement battle: Bombay HC orders the makers to deposit 2 crores!

In the copyright infringement battle, Bombay High Court has today ordered the makers of Rangoon to deposit Rs 2 crores.

After last minute speculations over the release of Shahid-Kangana-Saif’s Rangoon in regard to a copyright infringement case, the movie will finally have a smooth release today.

However, the Bombay High Court has asked the Rangoon team to deposit two crore rupees prior to the release of the historical drama.

On February 21, Roy Wadia’s legal team including senior counsels Navroz Seervai and Priyanka Khimani presented 19 similarities between Rangoon and Hunterwali alleging that Kangana Ranaut’s character is based on Fearless Nadia from the 1935 film. They also claimed that several mails were exchanged with filmmaker Vishal Bhardwaj and producers Ronnie Screwvala and Siddharth Roy Kapoor but to no avail.

According to Seervani, “It's a clear case of copyright infringement. Both the character as well as the script have been copied. Only instead of Fearless Nadia, Kangana's character has been named Jaanbaaz Miss Julia.There are several e-mails when Wadia was in Japan, desperately trying to reach him as UTV was about to back out of the film due to problems of copyright infringement. Vishal was deeply involved in the project and it was impossible for him to back out."

However, dismissing the claims the Rangoon team on February 22, cleared that Fearless Nadia is just a screen name like Dream Girl is for Hema Malini.

Bhardwaj’s counsel Virendra Saraf said, “Character copyright is not sustainable as per Indian Copyright Right Law. So if we consider Fearless Nadia as a character, it can't be a fit case under copyright law anyway.”

He added, “Nadia was an adopted name by Mary Evans much before Hunterwali (1935) came out. She added 'Fearless' later since she performed stunts on her own.”
