EXCLUSIVE: Bombay HC to give verdict on case against SSR’s sisters today; Here’s what Adv Madhav Thorat says

Sushant Singh Rajput's ex-girlfriend Rhea Chakraborty had filed a complaint against SSR's sisters and Dr Tarun Kumar for allegedly putting the late actor on illegal medication without physical consultation

In September last year, Rhea Chakraborty had filed a complaint against Sushant Singh Rajput’s sisters and Dr Tarun Kumar of Delhi’s Ram Manohar Lohia Hospital for allegedly putting the late actor on illegal medication without physical consultation. The Bombay High Court will deliver its verdict in the said case today. Pinkvilla reached out to Advocate Madhav Thorat, who is representing Sushant Singh Rajput’s family in the court. Here’s what he had to say. “The verdict is going to be out by 2 pm today, and we expect that the FIR registered by the Bandra police station against the SSR family will be quashed. The FIR is registered by Rhea Chakraborty against Sushant’s family members including his sisters and his doctor for illegally administering the banned drugs under the Narcotic Drugs and Psychotropic Substances Act (NDPS Act) which compelled him to commit suicide. So abetment of suicide and usage of illegal drugs which are banned under the NDPS Act schdule is what she has filed an FIR for before getting arrested,” the lawyer informs.

He further adds, “However, first of all let me tell you that Rhea Chakraborty herself in her reply said that she is the one who deserted Sushant for a considerable amount of time and wasn’t responding to his calls, which led him into depression. Secondly, the question of abetting for committing suicide does not arise. The medicines which are suggested by the doctors with the help of his sisters are allowed by the Medical Council of India (MCI), the apex body of this country which controls the medical regulations to prescribe these drugs upon patients especially in the midst of the Covid-19 pandemic. In fact, the regulation goes one step further and mentions that incase the patient is not available then the caretaker can approach the doctor through telephone and teleconference and get the prescription. So whenever a special permission is given for prescribing these medicines, despite them falling under the schedule of the NDPS Act as banned drugs, those drugs are not termed to be banned because they are allowed by the MCI in specific cases for specific purposes. Additionally, the CBI (Central Bureau of Investigation) has already registered an FIR in Bihar which was heard by the Supreme Court which covers 306, that is abetment of suicide. So once the provision of abetment is already under investigation by CBI, there was no requirement for the State of Maharashtra for registering an offence for abetment against the family or a fresh FIR on behalf of Rhea Chakraborty to be registered on the same lines. So per se, there is no case left on behalf of Rhea Chakraborty against the family.” 

Madhav Thorat also says, “Lastly, I don’t understand the delay in filing an FIR. Why did she wait for such a long time until she got arrested? Even otherwise the honourable Supreme Court has by it’s order directed the CBI to investigate any allegations regarding to the death of SSR. Therefore, in lieu of such explicit order, there was no requirement and/or authority of the State of Maharashtra to register any fresh FIR in the subject relating to the death of SSR.”
